Content Studio – Terms & Conditions

1. COPYRIGHT

1.1 All images and content produced by Content Studio remain the intellectual property of the photographer and are protected under applicable copyright laws.

1.2 Copyright is retained by Content Studio unless otherwise agreed in writing.

 

2. USAGE & DISPLAY

2.1 The Client grants Content Studio the right to use and display any images created under this agreement for promotional purposes, including but not limited to:

​

• Website and portfolio

• Social media platforms

• Advertising and marketing materials

• Editorial features and publications
   

2.2 If the Client requires confidentiality or non-disclosure, this must be agreed upon in writing prior to the shoot.

 

3. CREATIVE APPROACH & DELIVERY

3.1 Content Studio retains full creative control over the style, composition, and execution of all work.

3.2 While all reasonable efforts will be made to accommodate specific requests, these are not guaranteed and remain subject to:

​

• Environmental conditions (e.g. weather, lighting)

• Subject cooperation

• Venue restrictions
   

3.3 The photographer is not liable for missed shots due to factors beyond their control, including restricted access, timing constraints, or non-compliance by participants.

​

3.4 Variations in colour, exposure, and lighting may occur due to technical limitations and shooting conditions.

​

3.5 Content Studio maintains professional-grade equipment and backup systems; however, in the unlikely event of technical failure, liability is limited as outlined in Section 6.

 

4. PAYMENT TERMS

4.1 A non-refundable booking fee of 50% of the total project fee is required to secure the booking.

​

4.2 The remaining balance must be paid no later than 7 days prior to the scheduled shoot date, unless otherwise agreed in writing.

​

4.3 Additional services, edits, or deliverables requested post-booking must be paid in full prior to delivery.

​

4.4 All delivered content remains the property of Content Studio until full payment has been received.

​

4.5 Late payments will incur the following penalties:

​

• 30 days overdue: +10% fee

• 60 days overdue: +20% fee

• Accounts overdue by more than 6 months may be handed over for collection
   

 

5. FORCE MAJEURE

5.1 In the unlikely event that Content Studio is unable to fulfil the booking due to circumstances beyond reasonable control (including illness, injury, emergencies, or external disruptions), liability is limited to a full refund of any fees paid.

5.2 Where possible, Content Studio will assist in sourcing a replacement service provider, but this is not guaranteed.

 

6. FILES & DATA MANAGEMENT

6.1 All original files (RAW/digital negatives) remain the property of Content Studio and are not included in standard deliverables unless explicitly agreed.

6.2 Content Studio is not liable for loss or damage to files caused by circumstances beyond reasonable control. In such cases, liability is limited to a refund of fees paid.

 

7. SHOOT DAY CONDITIONS

7.1 Content Studio will be the primary professional photographer unless otherwise agreed.

​

7.2 Clients and guests are permitted to take personal photographs, provided they do not interfere with the photographer’s work.

​

7.3 Coverage duration will be as agreed in the booking. Any extensions must be pre-approved or may be charged additionally.

​

7.4 In cases of miscommunication resulting in missed sessions, Content Studio will, at its discretion:

​

• Reschedule the session, or

• Refund up to 50% of the shoot fee
   

 

8. LIABILITY

8.1 All participants follow direction at their own risk. Content Studio is not liable for any injuries, damages, or accidents occurring during a shoot.

 

9. CANCELLATION POLICY

9.1 If the Client cancels:

​

• More than 4 weeks prior: booking fee may be refunded at Content Studio’s discretion

• Less than 4 weeks prior: booking fee is non-refundable
   

9.2 Cancellations within 14 days of the shoot date will be charged at 100% of the total booking value.

​

9.3 Clients are advised to obtain appropriate insurance to cover potential cancellations.

 

10. DELIVERY

10.1 Content Studio will aim to deliver final edited content within:

​

• 2–4 weeks (standard projects)

• Up to 6 weeks during peak periods
   

10.2 Delivery timelines may vary depending on project scope and workload, but clients will be kept informed of any delays.

 

11. ACCEPTANCE

Payment of the booking fee confirms that the Client has read, understood, and agreed to these Terms and Conditions.
